Announcement of the National Certification and Accreditation Administration (CNCA) on Publishing the Compulsory Certification Implementation Rules  Information Submission, Transmission and Disclosure

 

In order to further promote the scientific, standardized and effective implementation of China Compulsory Certification (CCC), in accordance with the Regulations of the People’s Republic of China on Certification and Accreditation, the Provisions on Administration of China Compulsory Certification (CCC) and the Notice of CNCA on Clarifying the Adjustment Plan and Requirements for Compulsory Certification Implementation Rule Documents (CNCA Certification Document [2013] No. 39), CNCA has completed the preparation of the general implementation rule: Compulsory Certification Implementation Rules Information Submission, Transmission and Disclosure, which is used to improve the information disclosure system for compulsory certification, and to regulate and guide the content, requirements and procedures for CCC certification data and information submission, transmission and disclosure by parties involved in compulsory certification. The implementation rules is hereby published and shall take effect from the date of publishing.

1. Introduction

In accordance with the requirements of the Provisions on Administration of China Compulsory Certification (CCC) (Order No. 117 of General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China), and in order to improve the submission, transmission and disclosure mechanisms for CCC certification data information, and to standardize the information submission, transmission and disclosure activities of designated certification bodies, laboratories, the China Certification and Accreditation Association, and local quality supervision, inspection and quarantine authorities, these Rules are hereby formulated.

2. Scope 

These Implementation Rule apply to the submission, transmission and disclosure of relevant information among parties involved in CCC certification, including designated certification bodies for compulsory certification, designated laboratories, the CCC Mark Management Center, China Certification and Accreditation Association, local quality supervision, inspection and quarantine authorities, and other relevant parties.

3. Terms and Definitions

3.1 CCC Quality Basic Information 

It refers to various types of CCC certification‑related quality basic information required to understand the overall implementation and quality level of CCC certification, to analyze and identify problems and risk factors in the implementation of the certification scheme, and to further improve the certification scheme. It mainly includes:

1) CCC certificate data  

2) CCC quality analysis data  

- CCC certification acceptance and CB certificate transfer data  

   - Type testing and surveillance sample testing data  

   - CCC factory inspection data  

   - CCC certificate and certified enterprise data  

   - CCC certification mark data  

   - CCC factory inspector data  

3) Designated laboratory testing quality evaluation data

3.2 CCC Product Quality Surveillance Information

It refers to quality information needed by local quality supervision, inspection and quarantine authorities to carry out quality supervision of CCC products, specifically including CCC factory inspection plans and information on suspension, withdrawal and cancellation of certificates.

3.3 CCC Certification Administrative Supervision Information 

It refers to CCC certification-related information collected and obtained by local quality supervision, inspection and quarantine authorities during their administrative supervision activities, specifically including typical cases of CCC certification law enforcement, CCC exemption information, and CCC certification product quality risk information.

4. CCC Certification Information Submission

CCC certification information submission includes the submission of CCC quality basic information, CCC product quality surveillance information, and CCC certification administrative supervision information.

4.1 CCC Quality Basic Information

CCC quality basic information includes CCC certificate data, CCC quality analysis data, and designated laboratory testing quality evaluation data, which shall be submitted to the Certification Supervision Department of CNCA by designated certification bodies, designated laboratories, the China Certification and Accreditation Association, and the CCC Mark Management Center.

4.1.1 CCC Certificate Data  

CCC certificate data shall be submitted by designated certification bodies in real time, twice a week. Each designated certification body shall submit the data to the CNCA CCC Certificate Database in accordance with the requirements of the Notice on Further Clarifying the Requirements for CCC Certificate Data Submission (Official Letter of CNCA Information & Technology Department [2009] No. 3).

4.1.2 CCC Quality Analysis Data

CCC quality analysis data is submitted by designated certification bodies, designated laboratories and the China Certification and Accreditation Association through CNCA’s “Compulsory Certification Quality Analysis Information System” (cccq.cnca.cn) before 5th of November  in each year. The statistical period is from 1st November of the previous year to 31st October of the current year. The content to be submitted is detailed in Annex 1. Specific requirements are given in the Notice on Strengthening the Statistical Submission of Basic Data and Quality Data for China Compulsory Certification (CNCA Certification Document [2012] No. 42).

4.1.3 Designated Laboratory Testing Quality Evaluation Data

Designated laboratory testing quality evaluation data shall be submitted quarterly by designated certification bodies to the Certification Supervision Department of CNCA, before the 15th day of the first month after each quarter. The data statistical period covers the data and information of the previous quarter. For the details of the submission content, please refer to Annex 2.

4.2 CCC Product Quality Surveillance Information

CCC product quality surveillance information shall be submitted by designated certification bodies to local quality supervision, inspection and quarantine authorities. The content mainly includes CCC factory inspection plans and information on suspension, withdrawal and cancellation of certificates, as detailed in Annex 3.

Factory inspection plan data shall be submitted weekly through the CCC Certificate Law Enforcement Inquiry System.

Information on suspension, withdrawal and cancellation of certificates shall be submitted directly by designated certification bodies to local quality supervision, inspection and quarantine authorities once a month.

4.3 CCC Certification Product Quality Risk Information

CCC certification product quality risk information shall be submitted by local quality supervision, inspection and quarantine authorities. The content mainly includes results of provincial supervision spot checks on certified products and information on nonconformities found in such spot checks, quality safety accidents involving certified products, and CCC exemption data.

CCC exemption data is submitted through the “Information System for the Administration of Exemption from China Compulsory Certification” of CNCA.

CCC certification product quality risk information is submitted in real time through the CCC certification risk information early‑warning and notification channel, in accordance with the Notice of CNCA on Strengthening the Early‑warning and Analysis of Compulsory Certification Risk Information (CNCA Certification Document [2012] No. 97).

5. CCC Certification Information Transmission

CCC certification information transmission refers to the transmission of certificate status information for the same product category among designated certification bodies. Through information transmission among designated certification bodies, communication on CCC certification implementation is enhanced, certification criteria are unified, certification practices are strictly regulated, and orderly competition is ensured.

The information transmitted among designated certification bodies mainly includes information on certificate suspension and withdrawal, revision information of detailed rules for certification implementation of the certification body, product quality risk information, etc., as detailed in Annex 4.

Certification bodies with the same designated scope of CCC certification business shall transmit certification information at least once a month. In case of major issues, real-time transmission shall be carried out and the Certification Supervision Department of CNCA shall be notified. Each designated certification body shall designate a contact person for information transmission and specify the method of transmission.

6. CCC Certification Information Disclosure

The disclosure of CCC certification information means that designated certification bodies publish information on certified enterprises’ products and certificates on official websites. This is to facilitate certified enterprises and general consumers to obtain certification information and give play to the role of social supervision.

Information related to CCC certification that must be disclosed to the public mainly includes certificate information of certified enterprises, information on certificate suspension, restoration, withdrawal and cancellation, detailed rules for certification implementation of the certification body, standard version update implementation plans, the certification fee schedule, etc., as detailed in Annex 5.

Designated certification bodies shall announce the above information on their websites in real time.


Annex 1 CCC Quality A Data

1. CCC Certification Acceptance and CB Certificate Transfer Data

1.1 Number of New Applications  

Sum of initial applications and re‑certification applications for the same sub‑category of products within the statistical period.  

1.2 Number of Applications for Modification

Sum of applications for expansion or reduction of certification unit, and applications for modification of certificate information for the same sub-category of products within the statistical period.  

1.3 Total Number of Applications Accepted  

Sum of new applications and applications for modification  

1.4 Number of Certificates Issued Directly on the Basis of CB Reports

2. Type Testing and Surveillance Sampling Test Data

2.1 Number of First‑Time Passed Type Testing  

Number of first-time passed type testing for the same sub-category of products within the statistical period.

2.2 Number of First-Time Failed Type Testing

Number of first-time failed type testing for the same sub-category of products within the statistical period.  

2.3 First‑Time Passed Rate of Type Testing  

Percentage of the number of first-time passed type testing to the total number of type testing

2.4 Number of Type Testing Passed after Correction

Number of type testing that failed on the first attempt and passed after correction for the same sub-category of products within the statistical period.

2.5 Number of Type Testing Failed after Correction  

Number of type testing that failed on the first attempt and still failed after correction for the same sub‑category of products within the statistical period.  

2.6 Final Failure Rate of Type Testing  

Percentage of the number of type testing failed after correction to the total number of type testing.

2.7 Number of Surveillance Sampling Reports with Conformity

Number of surveillance sampling test reports with conformity for the same sub-category of products within the statistical period.

2.8 Failure Rate of Surveillance Sampling Tests  

Percentage of the number of surveillance sampling test reports with failure to the total number of reports for the same sub-category of products within the statistical period.

2.9 Item with the Highest Number of Failures

Content of the test item with the most failures detected from inspection of the same sub-category of products within the statistical period

2.10 Number of Type Testing Reports Issued  

Sum of the number of first‑passed type testing, the number of type testing passed after correction, and the number of type testing failed after correction for the same sub-category of products within the statistical period.  

2.11 Number of Surveillance Sampling Test Reports Issued  

Sum of the number of surveillance sampling reports without failures and the number of surveillance sampling reports with failures for the same sub-category of products within the statistical period.

2.13 Total Number of CCC Test Reports Issued (Domestic and Overseas)  

Sum of the number of type testing reports issued and surveillance sampling testing reports issued.

3. CCC Factory Inspection Data

3.1 Overall Situation of Factory Inspection

3.1.1 Number of Factory Inspections  

Sum of the number of factory inspections (domestic and overseas) for the same sub-category of products within the statistical period.  

3.1.2 Number of Inspections Passed  

Sum of the numbers of first-time passed inspections, the number of inspections passed after documentation verification, and the number of inspections passed after on-site verification of factory inspections (domestic and overseas) for the same product sub-category within the statistical period.

3.1.3 Number of Inspections Passed after Documentation Verification  

Sum of the number of factory inspections (domestic and overseas) passed after documentation verification for the same sub-category of products within the statistical period.

3.1.4 Number of Inspections Passed after On‑Site Verification  

Sum of the number of factory inspections (domestic and overseas) passed after on-site verification for the same sub-category of products within the statistical period.

3.1.5 Number of Inspections Failed  

Sum of the number of direct failures and failures after correction of factory inspections (domestic and overseas) for the same product sub-category within the statistical period.

3.2.8 Final Failure Rate of Initial Factory Inspections  

Percentage of the sum of the number of direct failures and the number of failures after correction of the initial factory inspection (domestic and overseas) for the initial certification application for the same sub-category of products to the total number of initial factory inspections within the statistical period.

3.3 Post-Certification Follow-Up Inspections

3.3.1 Number of Post-Certification Follow-Up Inspections  

Sum of the number of post-certification follow-up inspections (domestic and overseas) for the same sub-category of products within the statistical period.  

3.3.2 Number of Passed Inspections

Sum of the numbers of first-time passed inspections, the number of passed inspections after documentation verification, and the number of passed inspections after on-site verification of post-certification follow-up inspections (domestic and overseas) for the same sub-category of products within the statistical period.  

3.3.3 Number of Passed Inspection after Documentation Verification  

Sum of the number of post-certification follow-up inspections (domestic and overseas) passed after documentation verification for the same sub-category of products within the statistical period.  

3.3.4 Number of Passed Inspections after On‑Site Verification  

Sum of the number of post-certification follow-up inspections (domestic and overseas) passed after on-site verification for the same sub-category of products within the statistical period.

3.3.5 Number of failed Inspections  

Sum of the number of directly failed inspections and failed inspections after correction of post-certification follow-up inspections (domestic and overseas) for the same product sub-category within the statistical period.

3.3.6 Number of Batches under Surveillance Sample Testing

Sum of the number of batches under sample testing for post-certification follow-up inspection (domestic and overseas) for the same sub-category of products within the statistical period.  

3.3.7 Number of Batches Passed Surveillance Sample testing

Number of batches passed sample testing for post-certification follow-up inspection (domestic and overseas) for the same sub-category of products within the statistical period.  

3.3.8 Top three Clauses and Proportions of Nonconformities in Follow-Up Inspections  

Within the statistical period, top three clauses of the nonconformities found in follow-up inspections (domestic and overseas) for the same sub-category of products, and the proportions of these three nonconformity clauses to the total number of all nonconformities in follow-up inspections.

3.3.9 Final Failed Inspection Rate of Follow-Up Inspections

Within the statistical period, the percentage of the sum of the number of first-attempt failed inspections and the number of failed inspections after correction of post-certification follow-up inspections (domestic and overseas) for the same sub-category of products to the total number of follow-up inspections.

3.4 Unannounced Inspection (without Prior Notice)

3.4.1 Number of Unannounced Inspections  

Sum of the number of unannounced inspections (domestic and overseas) for the same sub-category of products within the statistical period.

3.4.2 Number of Passed Inspections  

Sum of the numbers of first-time passed inspections, the number of passed inspections after documentation verification, and the number of passed inspections after on-site verification of unannounced inspections (domestic and overseas) for the same sub-category of products within the statistical period.  

3.4.3 Number of Passed Inspections after Documentation Verification  

Sum of the number of unannounced inspections (domestic and overseas) passed after documentation verification for the same sub-category of products within the statistical period.  

3.4.4 Number of Passed Inspections after On‑Site Verification

4. CCC Certificate and Certified Enterprise Data

4.1 Statistics by Product Category

4.1.1 Number of ODM Certificates Issued  

Total number of ODM certificates issued for the same sub-category of products within the statistical period.  

4.1.2 Number of Certificates Suspended  

Total number of certificates suspended for the same sub-category of products within the statistical period.  

4.1.3 Number of Factories Suspended for Quality Reasons  

Total number of factories suspended for the reasons in Note 1 for the same sub-category of products within the statistical period.

Note 1: Reasons for suspension due to quality factors

(1) The certification applicant or interested party (including manufacturer, seller, importer, factory, hereinafter the same) violates national laws and regulations, or state/province-level supervision spot check results demonstrate that the product is nonconforming, but immediate withdrawal of certificate is not required;  

(2) The standards for certification implementation rules applicable to the certified product are revised or updated, and the certification applicant fails to go through the procedure for modification within the required timeframe or the product fails to meet the modification requirements;  

(3) Surveillance inspection results demonstrate that the certification applicant has violated the provisions of CCC certification implementation rules (including product sample testing failed, factory surveillance inspections failed, problems in product consistency found, etc.) or relevant requirements of the certification body, but certification requirements can be fulfilled by taking corrective actions;  

(4) The certification applicant or interested party fails to use the certificate and certification mark as specified and an investigation is required based on the circumstances;

(5) The certification applicant or interested party refuses to accept or fails to accept unannounced surveillance or sample testing within the specified period by national authorities or the certification body without justifications;  

(6) Information in the certificate (e.g., name or address of applicant/manufacturer/factory, model or specification of certified product) has been changed or there is evidence showing significant changes in the factory’s organizational structure or quality assurance system, and the certification applicant does not apply to the certification body for modification approval or filing.

Note 2: Reasons for withdrawal due to quality factors

(1) At the expiry of the certificate suspension period, the certification applicant fails to apply for certificate restoration, to take corrective actions, or satisfy the requirements even after corrective actions;  

(2) Modification in critical components, specifications and models of the certified products, as well as the design, structure, process and key material/raw material manufacturers related to complete machine safety or electromagnetic compatibility, resulting in serious safety hazards;  

(3) Follow-up inspection results from the certification body show serious defects in the factory’s quality assurance capability;  

(4) The certification applicant provides false samples, and the certified product is inconsistent with the sample for type testing;  

(5) The certification applicant or interested party violates national laws and regulations, or any state/province-level supervision spot check results demonstrate serious product defects, nonconforming results of product safety test items, or serious problems in consistency;  

(6) Defects in the certified product have caused quality safety accidents;  

(7) When the certificate has been suspended due to the circumstances described in 5.1 (5) or (6), the applicant or interested party still refuses to accept surveillance inspection or surveillance sample testing, or refuses to cooperate in sampling from the open market or sales premises for testing;  

(8) The certification applicant or interested party fails to use the certificate or certificate mark in accordance with regulations, or leases, lends or transfers such certificates or mark, where the circumstances are serious;

(9) Where fraudulent practices are committed, such as obtaining certificates by improper means including deception and bribery, or other serious illegal or non-compliant acts that directly affect the validity of certification results.

4.2 Statistics by geographical distribution (domestic provinces, autonomous regions, municipalities, Hong Kong, Macao, Taiwan, and foreign countries separately),includes number of new certificates, number of enterprises involved in new certificates, and number of entirely new enterprises.

4.2.1 Number of New Certificates  

Total number of new CCC certificates in each region within the statistical period.  

4.2.2 Number of Enterprises Involved in New Certificates  

Total number of enterprises involved in new certificates for CCC products within the statistical period.  

4.2.3 Number of Entirely New Enterprises  

Total number of enterprises that applied for CCC for the first time within the statistical period.  

4.2.4 Annual Basic Data for Overseas Factory Certification  

Within the statistical period, statistics shall be compiled by foreign country or region and by product sub-category, including: the number of newly issued certificates and the number of new enterprises in overseas countries, the number of valid certificates and enterprises, the number of initial factory inspections, the number of follow-up inspections, the number of overseas CB reports accepted, and the number of initial factory inspections and follow-up inspections subcontracted to overseas cooperative agencies. (Note: Europe is separately listed and counted as one region; individual European countries need not be listed separately.)

5. CCC Certification Mark

5.1 Number of Standard‑Size Marks Issued  

Total number of standard‑size marks issued for all CCC products within the statistical period.  

5.2 Number of Printing or Molding Mark Approval Certificates  

Total number of printing or molding mark approval certificates issued for all CCC certified products within the statistical period.

6. CCC Inspector Information

6.1 Total Number of Factory Inspectors with Valid Registration

Sum of senior inspectors and inspectors with valid registration.  

6.2 Number of Senior Inspectors with Valid Registration

Total number of senior inspectors with valid registration under the certification body as of the statistical cut‑off date.  

6.3 Number of Inspectors with Valid Registration

Total number of inspectors with valid registration under the certification body as of the statistical cut‑off date.  

6.4 Number of Newly Registered Inspectors  

Sum of newly registered senior inspectors and inspectors.  

6.5 Number of Newly registered Senior inspectors  

Total number of senior inspectors newly registered under the certification body within the statistical period.  

6.6 Number of Newly Registered Inspectors  

Total number of inspectors newly registered under the certification body within the statistical period.  

6.7 Number of Factory Inspectors Withdrawn During the Year  

Total number of the factory inspectors (including senior inspectors) whose registration was withdrawn within the statistical period under the certification body.

Note: The above data shall be statistically compiled separately for domestic and overseas regions.

Annex 2 Designated Laboratory Testing Quality Evaluation Data

1. Total number of test reports  

On a per-designated-laboratory basis, the total number of test reports issued for all products within the CCC Catalogue by designated laboratories within the statistical period.

2. Number of reports with only minor issues
